Terms and conditions

The terms and conditions are subject to change and this edition is dated 23rd July 2009. If you make any changes, please refer to the edition in force at the moment of your online booking.


1. BOOKING
VeniceStay-Apartments di Merigo Gabriele Proprietorship, VAT No. 03807460278 is the landlord of the building you have chosen.

Acceptance of your booking is subject to the availability of the flat chosen and payment of a deposit and is completed by the relative contract only when VeniceStay-Apartments sends you the voucher (by fax or e-mail).
VeniceStay-Apartments reserves the right to not accept bookings made by minors.
The contract is considered cancelled at the end of your stay in the flat.

2. PAYMENT
The prices quoted are in Euros.
All services and any additional charges are expressly indicated in the special section “Services and Promotions”.
Prices can change, from a minimum to a maximum price according to the season. The price will be calculated at the moment of the booking requested with an e-mail. Our prices include electricity, cold and hot water, heating (only for short stays), gas, linen. The assistance of our staff during check-in and check-out and cleaning at the end of your stay are not included in the daily rate unless clearly specified.

2.1 Payment with a Credit Card
When your booking is confirmed, VeniceStay-Apartments asks you to pay 20% of the total price of your stay.

If we are unable to charge this price it can be considered as the cancellation clause as agreed and thus the contract is cancelled.
The balance has to be paid upon arrival.

3. CANCELLATION BY THE CUSTOMER If the customer cancels a booking, Venicestay-apartments has the right to demand the following percentages of the overall cost of the flat:

- up to 29 days prior to the date of arrival: 20%

- from 28 to 15 days prior to the date of arrival: 50%

- from 14 to 7 days prior to the date of arrival: 75%

- less than 6 days prior to the date of arrival: there is no refund.

Any sums to be refunded will be paid back on the credit card the customer entered on the booking form (if cancelled within 20 days from the booking) or by means of a bank transfer. The customer has to send the details of the bank account to which the transfer is to be sent (specify IBAN and SWIFT). All refunds are net of bank charges.

4. CANCELLATION BY VeniceStay-Apartments
If it is ever necessary to offer a flat different from the one chosen or if a previously confirmed booking is cancelled, VeniceStay-Apartments will try to get in contact with you immediately to find a flat that has similar characteristics to the one requested.
If this is not possible or you disagree with the alternative solution, the contract will be cancelled and the whole deposit paid for your booking will be returned to you. You have no right to demand other damages from VeniceStay-Apartments.
If customers, as regards to the flat rented, fail to behave in a civil manner, VeniceStay-Apartments reserves the right to cancel the contract before its expiry date and to keep the whole sum paid.

5. ALTERATIONS
Any alterations the customer makes to the date of arrival and/or departure or extending/shortening the stay, must be communicated immediately by e-mail.
Changing the booking or extending it is possible only if the flat is free otherwise alternatives will be suggested out of those described on the website, always of course if they are available. The prices applied will be those in force for the days required and for the flat chosen at the moment of the request to change is made. If unsuccessful, it will be up to the customer to find an alternative lodging for the dates not included in the original booking. If the stay is cut short, there will be no refund.

6. DEPOSIT
Before crossing the threshold of the flat, the customer has to pay a deposit of €250 (in cash) as insurance for damages, accidents or missing items. To facilitate customers, the deposit can be paid in American dollars or English pounds. The flat is free to enter only after the deposit has been paid.
This deposit will be returned at the end of the leasing contract, normally at 10.30am on the day of departure, after the rooms have been checked by one of VeniceStay-Apartments’ staff.
If the customer leaves before the date established, we are authorised to keep the deposit until we have checked that nothing has been damaged. Only then will the deposit be returned by means of a bank transfer, net of bank charges.
In the case of vandalic acts, damage and/or theft in the rented flat by the customer, the latter is held personally responsible and not only to pay the deposit but also to pay the sum established by VeniceStay-Apartments for the damages suffered.

7. ARRIVAL AND DEPARTMENT TIMES
The flat is free to be entered at 3pm on the day of arrival and must be left by 10.30am on the day of departure unless agreed otherwise.
When you leave you must hand over the keys to our staff that will be there at 10.30am to check you out of the flat. When you arrive our staff will take you to the flat.
To simplify your arrival, please let us know (by phone, fax or e-mail) your means of transport stating the number of your flight or train or if you are coming to Venice by car. We can then advise you which public transport to take to reach the meeting place directly where you will find our staff who will take you to your flat.
If your time of arrival is after 7pm you have to pay a sum of €25.00 and €50.00 if it is after 11pm.
If, during your journey, you expect to be more than 30 minutes late please let us know immediately otherwise you have to €25.00 for each hour you delay.
Your time of departure will be agreed when you arrive; if the flat you have booked has no telephone it is up to you to call us to organise your departure.

8. NUMBER OF PEOPLE
The maximum number of people that are allowed to stay in the flat is stated in the description of each flat. More people can be added only if agreed previously, by fax or mail. Otherwise, the owner has the faculty not to accept the booking or cancel the contract.

9. PETS
Pets are allowed if requested in writing beforehand (by fax or e-mail) and this must be done before booking and before the booking confirmation.

10. CLEANING
VeniceStay-Apartments gives you the key to a clean flat, with linen and everything you will need during your brief stay.

11. RULES FOR CUSTOMERS
All condominium rules apply and must be observed. From 1pm to 3pm and from 11pm to 8am the people in the flat must not be rowdy. If the customer does not abide by the condominium rules and those established by VeniceStay-Apartments, we reserve the right to have you taken from the flat with no refund. In addition, VeniceStay-Apartments will ask for payment of all damages caused.
- rubbish must be placed outside the entrance door in the road by 8am (council rules establish a fine of €100 if this rule is violated);
- no smoking in any of the flats;
- customers are asked to leave the refrigerator clean and to defrost it the evening prior to departure;
- when departing, customers are asked to leave the flat tidy, with no bags of rubbish left in it and to collect the linen and kitchen utensils used and put them on the bed/table as applies.
If you need assistance of our staff during your stay for any reason that we do not consider serious, you will be charged €25.00 each time.
If the keys to the flat are lost, we are authorised to charge you the sum of €50.00 which includes changing the lock.
If you forget the keys inside the flat and our staff is needed to open the door, we are authorised to charge you the sum of €40.00.

12. LAWS AND JURISDICTION
The contract you have drawn up with us is governed by Italian law and subject exclusively to the jurisdiction of the Italian Court. The Court having jurisdiction is the Venice Court.

13. LIABILITIES
You and the occupants relieve, from this instant, the owner from any and all liabilities deriving from, or in any way related to the use and occupying the property, among which injuries, losses or damages due to fire, theft or criminal acts. We are not liable for any problem or damage that may arise/happen during your stay in the flat or for any damage/harm you may suffer from things or people, not attributable to the bad upkeep of the flat or damages caused by other occupants in the condominium, according to Italian law. We are not liable for any damages suffered by those using the flat. We are in no way liable if there are any mechanical breaks of the equipment or if there is an interruption in the public utility supplies (gas, water and electricity).
For any damage, voluntary or otherwise, that you may cause during your stay, we suggest opening a Civil Liability insurance policy prior to your departure.

14. FORCE MAJEUR
A force majeure cause is determined by airport strikes, bad weather conditions (like high tide for example), fire or any other factor that is out of our control and that cannot be avoided not even after having been duly careful. VeniceStay-Apartments is not liable for any problems arising from force majeure circumstances.
